Membership & Eligibility

The Friends with Benefit Program (“Program”) is a free rewards program offered by Benefit Cosmetics LLC (“Benefit”) to its customers located in the United States. Membership in the Program (“Membership”) is limited to individuals only and is limited to one (1) account per individual (“Account”). To create an Account, you will need to provide a valid email together with any other information requested. You must be a legal resident of the United States to be eligible and at least eighteen (18) years old. Benefit employees are not eligible for Membership.

BY APPLYING FOR MEMBERSHIP IN THE PROGRAM, YOU AGREE YOU HAVE AGE ELIGIBILITY AND LEGAL ELIGIBILITY TO BE BOUND BY THESE TERMS AND CONDITIONS (“Terms”). NO PURCHASE IS NECESSARY TO PARTICIPATE IN THE PROGRAM.

Affiliates of Benefit (e.g. Benefit UK) may also have similar loyalty programs. Membership in the Program does not confer any rights or benefits in the program of any other Benefit affiliate.

Membership Status

There are three (3) Membership statuses in the Program: Pink, Hot Pink, and Electric Pink. Achieving Hot Pink or Electric Pink status requires a minimum spend in a twelve (12) month period, as explained below. Each Membership status enjoys a variety of benefits made available by Benefit in its sole discretion from time to time (“Benefits”). Benefits may vary by status and some statuses may have more Benefits than others. The type, timing, and availability of any Benefits will be determined by Benefit in its sole discretion.

Membership is non-transferable and Program purchases must be made by the Program member.

Earning Points

Under the Program, all three (3) Membership statuses will have points credited to their Account for every dollar spent on fulfilled orders of merchandise from benefitcosmetics.com (“Points”). From time to time we may offer events where members can earn bonus Points and in that circumstance a bonus Points offer may apply.

Pink status: All members are automatically Pink status upon enrollment in the Program. Subject to removal from the Program (as explained below), a member will remain at Pink status indefinitely unless the minimum spend in a twelve (12) month period required to achieve Hot Pink or Electric Pink status is met. The twelve (12) month period measuring your minimum spend begins on the date you make your first fulfilled order of merchandise from benefitcosmetics.com as a member of the Program.

Members with Pink status earn one (I) Point per one dollar ($1) spent, plus bonus Points to jumpstart balance.

Hot Pink status: Hot Pink status is conferred on those Program members who spend a minimum of $200 on fulfilled orders of merchandise from benefitcosmetics.com during a twelve (12) month period. The twelve (12) month period measuring your minimum spend begins on the date you make your first fulfilled order of merchandise from benefitcosmetics.com as a member of the Program.

Members with Hot Pink status earn double (2x) Points per one dollar ($1) spent and the potential for additional Benefits or Rewards, such as merch and experiences.

Hot Pink status is good for the twelve (12) month period after the member qualifies; after that, requalification is required. If a member does not requalify for Hot Pink status and does not qualify for Electric Pink status, the member will revert to Pink status.

Electric Pink status: Electric Pink status is conferred on those Program members who spend a minimum of $400 on fulfilled orders of merchandise from benefitcosmetics.com during a twelve (12) month period. The twelve (12) month period measuring your minimum spend begins on the date you make your first fulfilled order of merchandise from benefitcosmetics.com as a member of the Program.

Members with Electric Pink status earn triple (3x) Points per one dollar ($1) spent and the potential for additional Benefits or Rewards, such as merch and experiences.

Electric Pink status is good for the twelve (12) month period after the member qualifies; after that, requalification is required. If a member does not requalify for Electric Pink status, and does not qualify for Hot Pink status, the member will revert to Pink status.

If you are using a promotional code or promotional discount with your order, the Points you earn will be based on the final value of eligible products after the promotional code or promotional discount has been applied. Points will not be earned for payment of gift cards, payment of taxes, payment of shipping, or for purchases made with an employee discount or gratis code.

To earn Points, you must be signed into your Account and complete your purchase with the same email address you registered your Account with.

Your Points balance will usually be updated within forty-eight (48) hours of purchase or activity. If you have earned Points by making a qualifying purchase which is subsequently refunded, the Points earned in relation to that purchase will be deducted from your Account balance.

It is your responsibility to ensure that all your personal details are kept up to date. Benefit will not be responsible for any lost, delayed, or undeliverable communications if you do not do so.

Redeeming Points; Rewards; Discounts

As part of the Benefits of your Membership, Points may be redeemed for rewards made available by Benefit from time to time in its sole discretion (“Rewards”).

Rewards can only be redeemed online at benefitcosmetics.com. Points themselves have no cash value and can only be redeemed for Rewards.

All unredeemed Points will expire twelve (12) months from the date they are originally earned. Please make sure you use your Points on available Rewards within this period. Once you have redeemed a Reward in exchange for the required number of Points, that redemption is final, and those Points cannot be re-added to your balance.

Program discounts cannot be used in conjunction with any other promotional codes or promotional discounts. Available Rewards or discounts may change from time to time, are subject to availability and additional terms and, if necessary, may be substituted or withdrawn at any time by Benefit. Before redemption, please carefully review any Reward or discount-specific terms and conditions.

Benefit’s Privacy Policy

BY SUBMITTING AN APPLICATION FOR MEMBERSHIP IN THE PROGRAM, YOU AGREE TO BE BOUND BY BENEFIT'S WEBSITE TERMS AND CONDITIONS (here) AND ACKNOWLEDGE YOU HAVE READ AND UNDERSTAND OUR PRIVACY POLICY (here). As is explained in our privacy policy, we use, and retain the information we collect to, among other things, detect security incidents, and protect against malicious, deceptive, fraudulent, or illegal activity, including attempts to manipulate accumulated Points and Benefits or to violate these Terms.

Communications with Benefit; How to Opt-Out

By submitting an application for Membership in the Program, you agree to receive advertising, marketing materials and other communications from Benefit. By signing up to join the Program, you will automatically be subscribed to receive marketing and Program emails. You may exercise choices and manage the communications you receive from us at any time by using the link to unsubscribe in email communications sent to you, updating your Account profile, or by emailing our Customer Care Team at customercareus@benefitcosmetics.com.

Changes, Termination or Removal from Program; Account Closure; Account Reopening

Program Changes
Benefit may, in its sole discretion, alter, limit, or modify the Program rules, regulations, Benefits, Rewards, eligibility for Membership, or any other feature of the Program or may terminate the Program any time in its sole discretion, by posting any such changes on the Benefit website. YOUR CONTINUED PARTICIPATION IN THE PROGRAM FOLLOWING SUCH CHANGES CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES.

Benefit reserves the right to make changes to its website and these Terms at any time. It is your responsibility to check or review these Terms from time to time to keep informed of any changes. By joining the Program, you hereby agree to be bound by any such changed Terms. If Benefit decides to change these Terms, we will post a new version on the website and update the “Last Updated” date set forth above.

Termination or Removal from Program
Benefit reserves the right to exclude individuals from the Program, remove Points from a member’s Account and/or cancel orders that are not consistent with Benefit’s policy in its sole but reasonable discretion such as failure to follow any terms of the Program, including, but not limited to the eligibility requirements, or Membership inactivity for more than twelve (12) months.

If your Membership is revoked or otherwise cancelled, any Points in your Account will automatically expire.

Account Closure
If you choose to close your Account, you can do so by opting out of the Program via self-closure. If you opt-out of the Program, you must agree to these terms:

  1. You will forfeit all your existing Points, Tier status, and status Benefits.
  2. You will no longer accrue Points on qualifying purchases.
  3. Closing your Account will not affect open orders or returns.

Account Reopening
If you reopen your Account within six (6) months of the date of Account closure, Benefit may, in its sole discretion, reissue the Points that were in your Account at the time of closure.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BENEFIT WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION OR MEMBERSHIP IN THE PROGRAM, INCLUDING DAMAGES ARISING OUT OF CHANGES TO OR TERMINATION OF THE PROGRAM. THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, LOSS OF DATA, INCOME OR PROFIT, LOSS OF OR DAMAGE TO PROPERTY AND CLAIMS OF THIRD PARTIES. TO THE EXTENT PERMITTED BY LAW, THE LIMITATIONS ON BENEFIT'S LIABILITY SET FORTH HEREIN SHALL APPLY WHETHER FOR BREACH OR REPUDIATION OF CONTRACT, OR WHETHER IN TORT, CIVIL LIABILITY BY WAY OF NEGLIGENCE, GROSS NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. BY AGREEING TO THESE TERMS, YOU WILLINGLY AGREE THAT YOU HAVE RELINQUISHED YOUR RIGHT TO SEEK THESE DAMAGES FROM BENEFIT AND THAT THIS IS A REASONABLE ALLOCATION OF RISK. THIS PROVISION DOES NOT APPLY TO NEW JERSEY RESIDENTS.

Choice of Law/Forum Selection

These Terms shall be governed by and construed in accordance with the laws of the State of California, excluding its conflict of law rules. If you are a U.S. resident you further expressly consent and agree to submit to the exclusive jurisdiction and venue of a court of competent jurisdiction located in San Francisco County, California. This provision does not apply to residents of New Jersey.

Severability

The provisions of this Program are intended to be interpreted in a manner which makes them valid, legal, and enforceable. In the event any provision is found to be partially or wholly invalid, illegal or unenforceable, such provision shall be modified or restricted to the extent and in the manner necessary to render it valid, legal, and enforceable.
